Legal Requests Policy

How RentPhoneUSA handles requests for user data from law enforcement, government agencies and courts, including requests for identity verification and biometric data.

9 sections

1. Scope

This policy explains how RentPhoneUSA responds to requests for user data from law enforcement, government agencies, courts and private parties in legal proceedings. It covers all data we hold, including account details, device access logs, payment records, and the identity verification (KYC) and biometric data we collect for phones rented with a SIM card.

2. What We Require

We disclose user data only in response to valid legal process issued under applicable law, such as:
  • A subpoena for basic account and subscriber information
  • A court order for non-content records such as access logs and login history
  • A search warrant for KYC documents, biometric data or other sensitive records

Requests must be in writing, on official letterhead or from an official government email domain, and must name the requesting authority and officer, cite the legal basis, and identify the specific account (for example by email address or phone number) and the time period requested. We reject requests that are overbroad, vague or not legally valid, and we may ask for clarification or narrowing.

3. Biometric and KYC Data

KYC is required only for phones rented with a SIM card, so KYC and biometric data exist only for those customers, and only until they are destroyed under the retention schedule in our Privacy Policy. Data that has already been destroyed cannot be produced.

Because biometric data is highly sensitive, we disclose it only when required by a warrant or an equivalent court order, or with the user's express consent. We never sell or trade biometric data.

4. Emergency Requests

If there is an imminent risk of death or serious physical injury, we may disclose limited information without legal process. Emergency requests must explain the nature of the emergency and why the information is needed to prevent harm, and must come from a verified law enforcement source. Any disclosure is limited to what is needed to address the emergency.

5. User Notice

Unless we are legally prohibited from doing so, or the request involves an emergency or notice would be counterproductive (for example where it could endanger a person or a child), we will notify the affected user before disclosing their data so they have an opportunity to object or seek legal counsel.

6. International Requests

Requests from authorities outside the United States must be made through the applicable mutual legal assistance treaty (MLAT) process, letters rogatory, or another legally recognized mechanism.

7. Data Preservation

We will honor a valid preservation request for up to 90 days while formal legal process is obtained. A preservation request does not by itself lead to disclosure.

8. Voluntary Disclosure

We do not volunteer user data to authorities. We do report and cooperate when we detect fraud or other illegal activity on our service, as described in our Acceptable Use Policy.
